These Terms of Service ("Terms") govern your access to and use of beamiva.com and your purchase or use of products and services offered through the Beamiva website.
The Beamiva brand and website are operated by Jusheng Innovative Technology LIMITED ("Beamiva," "we," "us," or "our").
Our online store is powered by Shopify, which provides the ecommerce platform and technology that enable us to offer our products and services online.
By visiting our website, creating or using an account, submitting an order, purchasing a product, requesting customization, or otherwise using our website or services (collectively, the "Services"), you agree to these Terms and to the policies referenced in them.
Please read these Terms carefully before using our Services. If you do not agree to these Terms, you should not use the Services.
Nothing in these Terms limits any consumer right or remedy that cannot legally be excluded, waived, or restricted under applicable law.
1. Eligibility and Online Store Terms
By using the Services, you represent that you have the legal capacity to enter into a binding agreement under the laws applicable to you.
If you use the Services on behalf of a business, company, organization, or other entity, you represent that you have authority to act on its behalf.
You may not use our Services or products for an unlawful or unauthorized purpose, in violation of applicable laws or regulations, to infringe intellectual-property or other legal rights, to transmit malicious software or harmful code, to interfere with the security or operation of our website, or in any manner prohibited by these Terms.
We may restrict or terminate access where reasonably necessary to protect Beamiva, our customers, our service providers, or the security and lawful operation of the Services.
2. Our Relationship With Shopify
Beamiva's online store is hosted and supported by Shopify. Shopify provides technology used for functions such as storefront operation, checkout, customer accounts, order processing, payment-related functionality, fraud prevention, security, and other ecommerce services.
Unless expressly stated otherwise, Beamiva is the seller of Beamiva products purchased through beamiva.com. Shopify provides the ecommerce platform and is not the seller of Beamiva products merely because our store uses Shopify technology.
Your use of certain Shopify-operated features may also be subject to Shopify's applicable terms and privacy practices.
3. Product Information
We make reasonable efforts to provide accurate and useful information regarding our products, including, where applicable, product descriptions, dimensions, materials, finishes, colors, images, electrical specifications, light-source information, wattage, color temperature, installation information, product availability, and pricing.
However, reasonable variations may occur.
Colors and Images
The appearance of colors, finishes, materials, and lighting effects may vary depending on screen or device settings, photography, ambient lighting, manufacturing batches, material characteristics, and viewing conditions. Digital images are intended to provide a reasonable representation of the product but cannot guarantee an exact visual match under every condition.
Natural and Hand-Finished Materials
Products made with or incorporating natural stone, marble, travertine, wood, glass, leather, shell, ceramic, hand-applied finishes, or other natural or artisanal materials may naturally vary in color, tone, grain, veining, texture, pattern, transparency, shape, or finish. Reasonable natural variation is not, by itself, a manufacturing defect.
Measurements
Product dimensions may be stated as approximate where appropriate. Customers should review measurements and installation requirements carefully before ordering. If exact dimensions are critical to a renovation, architectural, commercial, or installation project, please contact us before ordering.
4. Electrical Compatibility and Installation
Lighting products may require professional electrical installation. You are responsible for confirming that a product is appropriate for the intended installation location and electrical system.
Before installation, relevant factors may include supply voltage, frequency, junction-box compatibility, wiring, ceiling or wall structure, fixture weight, mounting requirements, bulb compatibility, driver compatibility, dimmer compatibility, indoor or outdoor rating, damp or wet-location suitability, local electrical codes, and building or safety requirements.
Where required by applicable law, building code, product instructions, or reasonable safety practice, installation should be carried out by a qualified or licensed electrician or other appropriate professional.
Do not install a fixture that appears visibly damaged.
To the extent permitted by applicable law, Beamiva is not responsible for damage caused by incorrect installation, improper wiring, incompatible electrical systems, unauthorized modification, misuse, failure to follow applicable instructions, or installation that does not comply with applicable safety or building requirements.
This section does not limit liability or consumer rights that cannot legally be excluded.
5. Prices and Currency
Product prices are displayed on our website in the applicable storefront currency. Prices may change from time to time.
A price change will not normally affect an order that we have already accepted, except where there is an obvious pricing error, the order is changed at your request, a quotation expressly provides otherwise, or applicable law permits a correction.
Depending on your location, your bank, card issuer, or payment provider may separately charge foreign-transaction fees, currency-conversion fees, or other financial-service fees. These third-party charges are not imposed by Beamiva.
6. Taxes, Duties, and Import Charges
Applicable sales tax or other taxes collected directly by Beamiva will be shown at checkout where required.
For international orders, additional charges may include import duties, VAT or GST, import taxes, customs-clearance charges, brokerage charges, or other government-imposed fees.
Responsibility for these charges is described in our Shipping & Delivery Policy. Unless expressly shown as included or prepaid at checkout, free shipping does not necessarily include customs duties, import taxes, VAT, GST, or other government charges.
7. Orders and Contract Formation
Placing an order through beamiva.com constitutes an offer to purchase the selected products under these Terms.
An automated order confirmation acknowledges that we received your order. It does not necessarily mean that the order has been finally accepted for fulfillment.
We may review an order for product availability, payment authorization, pricing accuracy, delivery availability, address validity, fraud or security concerns, product restrictions, and other reasonable fulfillment requirements.
We may decline or cancel an order where reasonably necessary, including because of product unavailability, an obvious pricing or listing error, payment failure, suspected fraud, an invalid or unsupported delivery address, shipping restrictions, legal or regulatory requirements, or circumstances that make fulfillment reasonably impracticable.
If we cancel an order after collecting payment, we will refund the applicable canceled amount to the original payment method, subject to applicable law.
8. Order Limits and Resale
We may reasonably limit or decline quantities where necessary to address suspected fraud, pricing errors, inventory shortages, unauthorized resale activity, unusual purchasing patterns, or other legitimate business or security concerns.
If you wish to place a large commercial or project order, please contact us so we can confirm availability, lead time, pricing, shipping requirements, and any project-specific terms.
9. Billing and Account Information
You agree to provide current, complete, and accurate information when placing an order or using an account, including, as applicable, your name, email address, telephone number, billing address, shipping address, and payment information.
You are responsible for updating information where necessary so that we can reasonably process and deliver your order. You must not knowingly provide false, misleading, unauthorized, or fraudulent payment or identity information.
10. Payment
Available payment methods are displayed at checkout. Payments may be processed through Shopify and/or other payment providers.
By submitting payment information, you represent that you are authorized to use the selected payment method. Payment providers may conduct authorization checks, fraud screening, identity or transaction verification, and other security procedures.
We do not necessarily receive or store your complete payment-card information. Please see our Privacy Policy for additional information about payment-related personal information.
11. Promotions and Discount Codes
From time to time, Beamiva may offer promotional discounts, discount codes, sale pricing, special offers, or other promotions.
Unless otherwise stated, promotions are subject to their stated period and conditions, may not be combined, have no cash value, may apply only to selected products, may exclude shipping, taxes, duties, or other charges, and may be corrected or canceled if affected by an obvious technical or pricing error.
If special promotion terms conflict with these Terms, the specific promotion terms control for that promotion, to the extent permitted by law.
12. Customized and Made-to-Order Products
Beamiva may offer customization or made-to-order services for selected lighting products. Customization may include dimensions, finish, color, hanging length, light source, color temperature, configuration, quantity, or other project-specific requirements.
Before production begins, customers may be asked to approve specifications, drawings, measurements, photographs, quotations, or other customization details. You are responsible for reviewing approved customization information carefully.
Production
A customized or made-to-order product may have a different production time, price, cancellation condition, return condition, or shipping requirement from a standard in-stock product.
Cancellation and Final Sale
Custom-made, personalized, modified, or made-to-order products become Final Sale once production has begun.
After production begins, these products are not eligible for cancellation, return, exchange, or refund for customer-related reasons, including change of mind, incorrect size or finish selection, changes to the installation site, customer-provided specification errors, design preference, or no longer needing the product.
If a cancellation request is received before production begins, Beamiva will check the order status and confirm whether cancellation remains possible.
Exceptions and Consumer Rights
This Final Sale rule does not remove remedies for a confirmed manufacturing defect, shipping damage, an incorrect item, a material deviation from the customization specifications confirmed in writing before purchase, or any other right that cannot legally be excluded.
Selecting a standard size, finish, or option from an ordinary product listing does not, by itself, make a product a custom order.

13. Order Changes and Cancellations
If you need to change or cancel an order, contact support@beamiva.com as soon as possible.
For standard products, we will determine whether fulfillment can still reasonably be stopped or changed. We cannot guarantee changes or cancellation after an order has entered production, customization, packing, dispatch preparation, or shipment.
Once an order has shipped, requests will generally need to be handled according to our Return & Refund Policy.
14. Shipping and Delivery
Shipping destinations, charges, processing times, estimated transit times, carrier arrangements, international customs matters, and delivery procedures are governed by our Shipping & Delivery Policy.
Beamiva currently offers delivery to eligible addresses in the United States, Canada, Australia, and the United Arab Emirates. Availability may vary depending on the product and delivery address.
Delivery estimates are estimates unless we expressly provide a guaranteed date in writing. Delivery may be affected by carrier disruptions, severe weather, customs processing, public holidays, seasonal demand, transportation congestion, local access restrictions, or other logistics events.
Please review the current Shipping & Delivery Policy before completing your purchase.
15. Delivery Information and Failed Delivery
You are responsible for providing a complete and accurate delivery address.
If a delivery fails because of an incorrect customer-provided address, an incomplete address, repeated missed delivery attempts, failure to respond to the carrier, failure to provide required customs information, failure to pay applicable customer-responsible import charges, or refusal of delivery, additional carrier, return, storage, customs, or reshipping costs may arise.
Any proposed customer charge or deduction will be reviewed and handled in accordance with our Shipping & Delivery Policy, Return & Refund Policy, and applicable law.
Costs caused by a Beamiva fulfillment or addressing error will not be passed on to the customer. Refusing a package does not automatically cancel the order or replace the return authorization process.
16. Returns, Refunds, and Exchanges
Returns, refunds, and exchanges are governed by our Return & Refund Policy.
Our current voluntary return policy permits qualifying return requests within the return period stated in that policy, subject to eligibility requirements.
Different rules may apply depending on whether a return involves a change of mind, customer selection error, shipping damage, manufacturing defect, incorrect item, missing component, or a product materially different from its description.
Applicable change-of-mind return shipping costs and restocking fees are described in the Return & Refund Policy. Where Beamiva confirms a qualifying product issue, remedies and return costs will be handled according to that policy and applicable law.
Nothing in our voluntary return policy or these Terms removes statutory consumer remedies that cannot legally be excluded.
17. Product Inspection
We recommend inspecting your order before scheduling installation. Where reasonably possible, check product identity, finish, dimensions, glass and fragile parts, mounting components, electrical components, supplied accessories, and overall condition.
If you identify visible shipping damage, an incorrect product, or missing components, please keep the packaging and contact us promptly. Do not install a visibly damaged fixture.
18. Warranty and After-Sales Support
Any Beamiva product warranty is separate from our voluntary return period.
Product-specific warranty terms, where applicable, should be reviewed together with the product information and warranty policy applicable at the time of purchase.
A manufacturing warranty does not ordinarily cover damage resulting from incorrect installation, improper wiring, incompatible electrical systems, misuse, unauthorized modification, customer-caused physical damage, accidents, or ordinary wear and tear, subject always to applicable consumer law.
A warranty exclusion does not remove consumer rights that cannot legally be excluded.
If you experience a potential manufacturing issue, contact support@beamiva.com before commissioning third-party repair or replacement work for which you expect reimbursement.
19. Accuracy of Website Information and Errors
We make reasonable efforts to keep our website accurate. However, our website may occasionally contain typographical errors, incorrect prices, incorrect dimensions, incorrect product information, incorrect availability information, incorrect shipping information, or other errors or omissions.
We may correct errors and update information when discovered. If an error materially affects an order you have already placed, we will take reasonable steps to contact you and provide appropriate options, which may include confirming the corrected information, allowing cancellation, or refunding an affected order.
We will not knowingly rely on obvious errors to mislead customers.
20. Changes to Products, Prices, and Services
We may add or discontinue products, update product designs or specifications, change prices or promotions, modify website features, or change available services from time to time.
Changes generally apply prospectively and do not remove rights relating to an order already accepted, except where required or permitted by applicable law.
21. Customer Accounts
Certain Services may allow customers to create or use an account. You are responsible for maintaining the confidentiality of your account credentials, providing accurate account information, restricting unauthorized access to your account, and promptly notifying us if you reasonably suspect unauthorized use.
We may suspend account access where reasonably necessary for security, fraud prevention, legal compliance, or a material violation of these Terms.
22. Intellectual Property
Unless otherwise stated, the content made available through beamiva.com, including the Beamiva name, logos, branding, website designs, text, product descriptions, graphics, photography, videos, illustrations, page layouts, product-selection presentations, and other original website content, is owned by, licensed to, or lawfully used by Beamiva and/or applicable rights holders.
The content may be protected by copyright, trademark, design, and other intellectual-property laws.
You may use our website for lawful personal or business purchasing purposes. You may not, without appropriate permission, reproduce substantial protected content, republish protected content, sell or commercially exploit protected content, remove intellectual-property notices, falsely represent Beamiva content as your own, create unauthorized derivative commercial works, or use our trademarks in a manner likely to cause confusion regarding affiliation or endorsement.
Nothing in these Terms grants ownership of Beamiva intellectual property to you.
23. Customer Materials, Reviews, and Submissions
You may provide Beamiva with reviews, feedback, comments, photographs, videos, drawings, customization references, design requirements, or other content. You represent that you have the right to provide the materials you submit and that doing so does not knowingly infringe another person's rights.
Customer-Service and Customization Materials
Photographs, videos, drawings, and other materials submitted privately for customer support, defect assessment, returns, warranty claims, or product customization may be used as reasonably necessary to provide the requested service.
We will not treat the mere submission of private customer-service materials as permission to use those materials publicly for advertising.
Reviews and Publicly Submitted Content
If you intentionally submit content for publication as a product review, testimonial, social submission, or similar public feature, you authorize us, to the extent permitted by law and subject to any choices presented when you submit it, to display and use that content for operating and promoting Beamiva.
We may remove public content that is unlawful, fraudulent, abusive, defamatory, infringing, misleading, malicious, or unrelated to the relevant service. Our handling of personal information within submitted content is subject to our Privacy Policy.
24. Prohibited Uses
You may not use our website or Services to violate applicable law, infringe intellectual-property rights, submit fraudulent orders, use stolen or unauthorized payment information, impersonate another person, transmit malware or harmful code, attempt unauthorized access to systems or accounts, circumvent website security controls, disrupt website functionality, harvest personal information unlawfully, conduct abusive automated activity, misrepresent your relationship with Beamiva, engage in fraud or deceptive activity, or assist another person in doing any of the above.
We may restrict access, cancel fraudulent transactions, or take other reasonable action where necessary to address prohibited conduct.
25. Third-Party Services and Links
Our website may contain or use third-party payment services, shipping services, analytics tools, advertising services, social-media platforms, apps, integrations, or links to independent websites.
Beamiva does not control the independent operation, content, privacy practices, or terms of third-party services. Your use of an independent third-party service may be subject to that provider's own terms and privacy policy.
The inclusion of a third-party link does not necessarily mean that Beamiva endorses every product, statement, or service offered by that third party.
26. Privacy
Our collection, use, disclosure, and other processing of personal information is described in our Privacy Policy.
By using the Services, you acknowledge that personal information may be processed as described in that policy. The Privacy Policy explains matters including information we collect, cookies and similar technologies, Shopify's role, service providers, advertising, international transfers, privacy choices, and applicable privacy rights.
27. Service Availability
We aim to keep beamiva.com reasonably available and secure, but we cannot guarantee that the website will operate without interruption at all times.
Availability may be affected by maintenance, software updates, hosting issues, network outages, cybersecurity events, third-party service interruptions, or circumstances beyond our reasonable control.
Where practical, we may modify or temporarily suspend website functionality to maintain security or performance.
28. Disclaimer of Certain Warranties
To the maximum extent permitted by applicable law, the website and general website functionality are provided on an "as available" basis.
We do not guarantee that the website will always be uninterrupted, every technical error will immediately be corrected, every third-party service will always remain available, or electronic communications will always be completely secure.
This section does not exclude or restrict product guarantees, product warranties, statutory consumer rights, rights relating to defective goods, rights relating to materially misdescribed goods, or any other obligation that cannot legally be excluded.
29. Limitation of Liability
To the maximum extent permitted by applicable law, Beamiva, its affiliates, employees, officers, service providers, suppliers, and contractors will not be liable for purely indirect, incidental, special, or consequential losses arising solely from use of the website where such liability may lawfully be excluded.
Nothing in these Terms excludes or limits liability to the extent that exclusion or limitation would be unlawful.
In particular, nothing in these Terms is intended to exclude or restrict liability or remedies relating to fraud or fraudulent misrepresentation, rights that cannot legally be waived, mandatory consumer guarantees, liability that applicable law prohibits us from excluding, or any other non-excludable statutory obligation.
Consumer-protection laws applicable to your purchase take priority over any inconsistent limitation in these Terms.
30. Indemnification
To the extent permitted by applicable law, you agree to be responsible for reasonable losses, claims, or liabilities arising directly from your unlawful use of the Services, your material breach of these Terms, or your infringement of a third party's legal rights.
This section does not create liability for matters caused by Beamiva and does not apply where prohibited by applicable consumer law.
31. Events Beyond Reasonable Control
We are not responsible for delay or failure caused by circumstances outside our reasonable control to the extent permitted by applicable law.
Examples may include natural disasters, severe weather, fire, epidemics or public-health emergencies, war or civil disturbance, government action, customs disruption, transportation disruption, major carrier interruption, labor disruption, utility failure, internet or telecommunications outages, or other similar events.
Where such an event affects an existing customer order, we will take reasonable steps to communicate material delays and provide any remedies required by applicable law.
32. Termination or Restriction of Access
We may restrict or terminate access to the Services where reasonably necessary because of fraud, abuse, security threats, illegal activity, material violation of these Terms, or legal requirements.
Termination of website access does not eliminate rights or obligations that arose before termination. Sections intended by their nature to survive termination, including provisions relating to intellectual property, payment obligations, liability, and dispute resolution, may continue to apply.
33. Severability
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary to make it enforceable where permitted. If it cannot be enforced, it will be severed without invalidating the remaining provisions.
34. No Waiver
If Beamiva does not immediately enforce a provision of these Terms, that does not mean we permanently waive that provision or any other right. Any waiver must be interpreted narrowly and does not automatically apply to future circumstances.
35. Assignment
You may not transfer contractual rights or obligations relating to an order in a manner that would materially interfere with fulfillment without our agreement, except where applicable law permits otherwise.
Beamiva may transfer rights or obligations in connection with a legitimate corporate restructuring, merger, acquisition, sale of business, financing, or similar transaction, provided that doing so does not unlawfully reduce your consumer rights.
36. Entire Agreement
These Terms, together with applicable Beamiva policies and order-specific terms, form the agreement governing your use of the Services and purchases from Beamiva.
Relevant policies may include the Privacy Policy, Shipping & Delivery Policy, Return & Refund Policy, Warranty Policy, product-specific terms, custom-order quotations or specifications, and promotion-specific terms.
If a product-specific or individually agreed written term conflicts with a general provision of these Terms, the more specific agreed term will apply to that matter, subject to applicable law.
37. Order-Specific Consumer Rights
Beamiva sells to customers in multiple jurisdictions. Nothing in these Terms is intended to deprive a consumer of mandatory legal protections available in the jurisdiction applicable to their purchase.
This may include non-excludable rights relating to product quality, product conformity, defective goods, incorrect fulfillment, remedies, refunds, repairs, replacements, misleading conduct, or other consumer protections.
Where mandatory consumer law provides greater protection than these Terms, the mandatory law applies.
38. Governing Law
These Terms and contracts entered into with Jusheng Innovative Technology LIMITED through beamiva.com are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law principles.
However, this choice of law does not deprive consumers of mandatory protections that apply under the laws of their place of residence or another jurisdiction where such protections cannot legally be waived.
Nothing in these Terms requires a consumer to give up a right to bring a claim before a court or authority where applicable law provides that right.
39. Disputes
If a dispute arises relating to an order or the Services, we encourage you to contact us first at support@beamiva.com.
Please include relevant information such as your order number, contact information, description of the issue, and the resolution you are requesting. We will make reasonable efforts to review and resolve the matter.
If a dispute cannot be resolved informally, it may be brought before a court or other competent authority as permitted by applicable law.
Subject to mandatory consumer rights and applicable jurisdictional rules, the courts of the Hong Kong Special Administrative Region may have jurisdiction over disputes relating to these Terms.
Nothing in this section limits a consumer's right to use a court, tribunal, regulator, consumer-protection authority, or other dispute-resolution mechanism that applicable law makes available.
40. Changes to These Terms
We may update these Terms from time to time to reflect changes in our business, products or Services, ecommerce technology, operational practices, applicable laws, regulatory requirements, or other legitimate business needs.
The latest version will be posted on this page with an updated Last Updated date.
Changes generally apply from the date they are published. Material changes will not retroactively remove rights that already arose under an accepted order where doing so would be prohibited by applicable law. Where applicable law requires additional notice or consent, we will provide it.
